AS 08.26.040. Requirements For Organizational License.
- (a) The department shall issue an organizational license to a person who is not an individual if
- (1) the person maintains a place of business in this state;
- (2) the person is in compliance with the state and federal requirements that apply to the organization;
- (3) the person submits proof satisfactory to the department that the person is able to be bonded and insured;
- (4) the results of the criminal history record checks of the person under AS 08.26.070
show that the person or following individuals have not been convicted of a felony within the 10 years before the
application that would affect the person's or individuals' ability to provide the services of a guardian or
conservator, whichever is applicable, competently and safely for the ward or protected person:
- (A) the officers of the organization, if the organization is a for-profit corporation or a nonprofit corporation;
- (B) the members or manager of the organization, if the organization is a limited liability company; or
- (C) the partners of the organization, if the organization is a partnership, limited partnership, or limited liability
partnership;
- (5) the person designates in writing one of the following individuals to be responsible within the organization for
monitoring the organization's compliance with this chapter and the other laws of this state:
- (A) an officer of the organization, if the organization is a for-profit corporation or a nonprofit corporation;
- (B) a member or manager of the organization, if the organization is a limited liability company;
- (C) a partner of the organization, if the organization is a partnership, limited partnership, or limited liability
partnership;
- (6) all of the individuals employed by the person to provide the services of a private professional guardian or private
professional conservator for the organization have licenses under this chapter; and
- (7) the person satisfies the application requirements of AS 08.26.060.
- (b) If the organization's employees have licenses under both AS 08.26.020 and 08.26.030, the license issued under (a) of this section
shall cover providing the services of a guardian and a conservator.
- (c) If the organization's employees have licenses only under AS 08.26.020 but not under AS 08.26.030
, the license issued under (a) of this section is limited to providing the services of a guardian.
- (d) If the applicant's employees have licenses under AS 08.26.030
but not under AS 08.26.020
, the license issued under (a) of this section is limited to providing the services of a conservator.
