Section 17. Application

11 AAC 89.017. Application

(a) An applicant for an exploration incentive credit under this chapter must submit to the commissioner a written request for the credit. The request must include a plan as required by (b) of this section. The application must be received at least 60 days before drilling or geophysical work commences.

(b) The applicant shall submit a plan, including a map or a drawing, based on data reasonably available at the time of the application, containing the following information:

(1) the sequence and schedule of the operations to be conducted, including the date the operations are proposed to begin and their proposed duration;

(2) projected eligible costs associated with the proposed operations; and

(3) estimated number of feet drilled or miles of data to be gathered.

(c) The applicant may submit to the commissioner a copy of any plan of operations required under 11 AAC 83.158 and any amendment of that plan to provide information required under (b)(1) and (b)(3) of this section.

(d) The applicant may submit a proposed amendment to the plan for approval by the commissioner. If the plan amendment is approved, the commissioner will notify the applicant in writing.
