If the commissioner selects a method of bidding which sets a royalty reserved to the state, either fixed or as the bid variable, based on a sliding scale, the sliding scale will be determined, according to a method chosen at the commissioner's discretion which will be based on volume of production or other factors. The method chosen by the commissioner will consider the prolongation of the economic life of the oil and gas reservoir or reservoirs underlying the sale area or lease to which the sliding scale is to be applied.
