11 AAC 69.050. Proof of claim to escheated real property

A claimant to escheated real property under AS 38.95.240 (e) must substantiate the claim, to the satisfaction of the commissioner, by providing authenticated copies of deeds and other title instruments that demonstrate an unbroken chain of title resulting in the claimed ownership, and authenticated copies of other appropriate documents, which might include

(1) a final judgment of a state or federal court that

(A) conclusively determines the heirs to the subject property and their respective shares, or

(B) resolves gaps in the claimant's proposed chain of title, or

(C) awards rights to claim the real property in respective shares to a corporation, its directors, officers, or shareholders, or court designees; and

(2) official written confirmation of the election or appointment of a director to the board of directors of a corporation, with the specific dates of office identified, and official written confirmation of the director's express authority under the corporate bylaws to represent the corporation in real estate transactions.
