A person whose purchase contract or lease issued by the department
(1) has been administratively foreclosed or terminated for cause within the past three years is ineligible for a new purchase contract or lease issued by the department;
(2) is currently in default for nonpayment is ineligible for a new purchase contract or lease issued by the department until the amount in default is paid in full; or
(3) is currently in default for nonpayment of municipal taxes or assessments, after the municipality notifies the department of the nonpayment and the department notifies the purchaser or lessee of the default, is ineligible for a new purchase contract or lease issued by the department until the default is remedied.
