The hearing office shall determine whether the behavior under 22 AAC 20.290(1) - (8) is of such magnitude that the prisoner may not be released pending a review by the board. However, the hearing officer may not release the prisoner to parole if
(1) the behavior would be a violation of the law, punishable by imprisonment;
(2) the behavior would constitute a major or high moderate infraction under 22 AAC 05.400;
(3) the behavior would fall within 22 AAC 20.290(4) - (8).
