22 AAC 05.540. Law books

(a) A prisoner must have access to law library materials that include, as a minimum,

(1) Alaska Statutes;

(2) Alaska Administrative Code;

(3) local ordinances;

(4) Alaska Digest;

(5) Alaska Reporter;

(6) Alaska Rules of Court;

(7) advance opinions of the Alaska Supreme Court and the Alaska Court of Appeals;

(8) list of Alaskan attorneys, with addresses and telephone numbers;

(9) Black's Law Dictionary;

(10) Shepard's Alaska Citations;

(11) a book explaining how to perform legal research;

(12) a criminal law handbook;

(13) a handbook on criminal procedure;

(14) a handbook on criminal appeals;

(15) an evidence handbook;

(16) a layman's legal dictionary;

(17) handbook on Habeas Corpus; and

(18) a prisoner rights handbook.

(b) No restrictions on the use of law library materials may be imposed except for those interferences normally and routinely imposed by the requirements of the facility daily schedule, the custody status of the individual prisoner, and the security of the facility. A prisoner may request the assistance of the law librarian in the use of law library materials.

(c) A prisoner confined in segregation or in maximum security must be afforded access to the law library unless an individualized determination is made by the superintendent or assistant superintendent that the prisoner presents a substantial threat to the security or order of the facility, or unless the prisoner is in punitive segregation. Facility staff may bring legal materials to the prisoner's cell, escort the prisoner to the law library, or make photocopies of legal materials and allow access by the prisoner. If not permitted to use the law library, the prisoner is entitled to at least four law books in his or her cell at any one time.
