If the ombudsman receives written notice from an agency which has provided a confidential record that it asserts a privacy interest in the record, the ombudsman
(1) will, in his discretion, disclose the record only to the person or persons within the agency having custody of the record; and
(2) will, in his discretion, make any other disclosure of the record only in accordance with 21 AAC 20.380.
