(a) Unless otherwise provided in 20 AAC 40.200 - 20 AAC 40.270 and subject to (c) of this section and any specific limitations on eligibility the authority establishes for a particular grant, any entity, including a government agency, with an interest in serving beneficiaries or otherwise advancing the mission of the authority is eligible to receive an authority grant. An individual is not eligible for an authority grant.
(b) Before a native entity may receive an authority grant, the entity must submit to the authority a resolution approved by the entity's governing body that waives the entity's sovereign immunity from suit with respect to claims by the authority or the state arising out of activities related to the grant.
(c) An eligible applicant for an authority grant, including the intended recipient of a designated grant under 20 AAC 40.250, must provide to the authority
(1) a list identifying each grant that was awarded to the applicant within the preceding 36 months, including the name of the grantor, the purpose of the grant, the period of the grant, and the amount awarded under the grant; and
(2) written authorization directed to each grantor of a grant identified under (1) of this subsection to provide the authority with information about the applicant's performance of the grant.
