(a) The commission will issue an interim-use permit to an applicant for an entry permit whose application is classified at a point level that could ultimately qualify the applicant for an entry permit.
(b) The commission will, in its discretion, issue an interim-use permit to an applicant who is contesting a priority classification by the commission that does not qualify the applicant for an entry permit under AS 16.43.270 only if the applicant claims sufficient points to qualify for the permit and the applicant presents an issue which, if resolved in the applicant's favor, would entitle the applicant to an entry permit.
