(a) An interim-use permit is required under 20 AAC 05.100 and 20 AAC 05.110 for any commercial fishery not designated in 20 AAC 05.300 and 20 AAC 05.310.
(b) For all applicants for interim-use permits, there is a rebuttable presumption that the applicant is unable to participate actively in the fishery if (1) for setnet permits, gear code 04, the applicant has not attained age 10; and (2) for all other permits, the applicant has not attained age 16. The rebuttable presumption established in this subsection does not apply to gear codes 12 (hand picking), 18 (shovel), 21 (pound), and 99 (other).
