(a) The department will waive a fee for performing an inspection or analysis under this chapter if the department finds that
(1) after conducting an inspection or analysis in response to a complaint, the complaint was unfounded;
(2) a public health or environmental emergency exists, and an inspection or analysis at no cost to the owner or operator is needed to meet the emergency; or
(3) an inspection or analysis is necessary to prevent a public health or environmental emergency, and charging a fee for that inspection would not be in the public interest.
(b) A circumstance listed in (a) of this section does not constitute an automatic fee waiver.
