(a) If the department believes that a certified laboratory consistently submits erroneous data or is not in compliance with this chapter, the department will, in its discretion, and subject to the availability of appropriations from the legislature and the staffing needs of other projects, conduct an onsite inspection. As part of the inspection, the department will review the laboratory's work product and quality control systems. If the inspection shows that the laboratory fails to maintain quality control standards as required under 18 AAC 80.1100(b)(1), the department will report the deficiencies to the laboratory in writing and provide an opportunity for response. Based on the results of the inspection and on the information supplied in the laboratory's response, if any, the department will, in its discretion, reduce the laboratory's certification status, suspend certification, or revoke certification. The laboratory shall pay the inspection fee required by 18 AAC 80.1110 if the inspection reveals that the laboratory fails to maintain quality control system as necessary to stay in compliance under 18 AAC 80.1100(b)(1) or is not in compliance with this chapter.
(b) A person aggrieved by a department certification decision under (a) of this section may request a review under 18 AAC 80.1920. This subsection does not affect a person's rights under AS 44.62 (Administrative Procedure Act).
