(a) In addition to the requirements of 18 AAC 78.513(f) , the owner or operator of a UST who has been awarded financial assistance under this chapter shall enter into a written agreement with the department to ensure that the owner or operator will take sufficient abatement and containment measures in accordance with an approved corrective action plan to stabilize the site and to prevent the migration of contamination into an uncontaminated area.
(b) Based on availability of money, the department will, in its discretion, require the owner or operator to fully implement the approved corrective action plan at the owner's or operator's expense.
