(a) The board will annually allocate money appropriated to the storage tank assistance fund under AS 46.03.410 to the following programs or projects:
(1) the tank cleanup program authorized by AS 46.03.420 ;
(2) previously funded continuing cleanup projects authorized under AS 46.03.420 ;
(3) the tank cleanup loan program authorized by AS 46.03.422 ;
(4) previously funded continuing cleanup loan projects authorized under AS 46.03.422 ;
(5) the tank upgrading and closure program authorized by AS 46.03.430 .
(b) In making the annual allocations under (a) of this section, the board will consider
(1) the amount of money in the storage tank assistance fund;
(2) the money required to meet the needs for each program, as supported by approved applications;
(3) the requirement under AS 46.03.420 (a) that the greatest priority be given to funding those UST's that present the greatest threat or potential threat to human health;
(4) the ability to phase the costs of grants for corrective action;
(5) the need to reserve at least 15 percent of each year's allocation to the tank cleanup program for cost increases, emergency grants, contingencies, year-end grant awards, and audits of final cost statements; and
(6) the need to reserve at least 10 percent of each year's allocation to the tank upgrading and closure program for cost increases, contingencies, and year-end grant awards.
(c) Under the board's direction, the department will request the necessary spending authorizations to implement (b) of this section. A revision by the department to an annual program allocation made under (a) of this section is invalid unless approved by the board.
(d) Repealed 4/16/2000.
