(a) If a loan request made under AS 46.03.422 is denied, inactivated, or significantly modified by the department, an applicant may file a written request for reconsideration within 30 days after receipt of notice of the department's decision. If reconsideration is sought, the time for requesting dispute resolution under 18 AAC 78.950 does not run until the department issues a written determination on the request for reconsideration.
(b) The department will reconsider a request upon a showing by the applicant that
(1) the circumstances contributing to the department's decision have undergone a substantial change;
(2) additional relevant information can be provided to the department that was not initially available; or
(3) the department made a clerical error.
(c) The owner or operator who disputes a loan denial by a finding of ineligibility may seek resolution of the dispute by the board under 18 AAC 78.950.
