Section 508. Application requirements

18 AAC 78.508. Application requirements

(a) To be considered for financial assistance under this chapter, a person must

(1) be the owner or operator of a UST, other than the state or federal government;

(2) comply with (b) - (f) of this section and with 18 AAC 78.509; and

(3) submit a completed application to the department in accordance with deadlines established by AS 46.03.420 , 46.03.422, and 46.03.430.

(b) The owner or operator applying for financial assistance under this chapter must submit to the department, on forms supplied by the department,

(1) a completed priority ranking questionnaire;

(2) a completed UST registration form and the applicable registration fee, if not previously submitted under AS 46.03.380 (a) or 46.03.385(a), for a UST currently in service;

(3) if not previously submitted under sec. 5, ch. 96, SLA 1990 or 18 AAC 78.020, a "tank out-of-service" form for a UST installed after January 1, 1974 that has been taken out of service or permanently closed by the owner or operator before a form is submitted under this subsection;

(4) a completed site assessment, or the results of a tank tightness test for a UST that was used after September 5, 1990;

(5) a signed statement from the owner or operator indicating ability to comply with federal financial responsibility requirements;

(6) if seeking financial assistance under AS 46.03.420 or 46.03.430, a certification of eligibility in accordance with 18 AAC 78.506 or 18 AAC 78.507; and

(7) other information required by the department to fully document the work for which financial assistance is requested.

(c) If a UST currently or previously owned or operated by the person applying for financial assistance has discharged petroleum to the environment, the person must submit to the department proof that the person reported the discharge immediately as required under AS 46.03 or this chapter after learning of the discharge. The person may meet the requirements of this subsection by submitting a copy of a notice of release letter issued by the department that indicates that the release was reported in accordance with 18 AAC 78.220.

(d) An owner or operator applying for reimbursement of expenditures under a grant must submit to the department paid invoices showing the dates when and locations where the work was performed.

(e) An owner or operator applying for a loan under 18 AAC 78.515 or 18 AAC 78.521 must submit the information required by 18 AAC 78.521.

(f) An owner or operator applying for a grant to upgrade or close a UST under 18 AAC 78.520 must submit to the department

(1) a narrative report that describes in detail the proposed upgrade or closure;

(2) a preliminary estimate of eligible costs; and

(3) the name and qualifications of a firm or person likely to perform the work; if the owner or operator receives a notice of eligibility under 18 AAC 78.534(e) , the owner or operator must comply with 18 AAC 78.509.

(g) The owner or operator applying for financial assistance under this chapter shall notify the department of any changes to the owner's or operator's mailing address. The department will send documents to the last address provided by the owner or operator and will not search for the owner or operator.
