If a grantee fails to comply with any provision of AS 46.16.010 - 46.16.100, this chapter, or the grant agreement, the department will, in its discretion, withhold payments and recover previous payments by any legal means. Success of a project in demonstrating innovative methods of gold recovery, water pollution control, water use reduction, or waste disposal is not a factor in grant payment if the grantee has shown good faith in carrying out the project.
