(a) No person may construct or operate a hazardous waste management facility for which a permit is required under 18 AAC 62, a hazardous waste underground injection well classified under 40 C.F.R. 144.6(a)(1), a PCB incinerator for which approval to dispose of polychlorinated biphenyls (PCBs) or PCB Items is required under 40 C.F.R. 761.70, or a chemical waste landfill for which approval is required under 40 C.F.R. 761.75, without the required permit or approval and the corresponding approval under this chapter for the siting of that facility.
(b) Department approval under this chapter is not required for a facility that, on March 31, 1989
(1) is in compliance with the RCRA (Resource Conservation and Recovery Act of 1976) interim standards set out at 40 C.F.R. Part 265 (codified as of July 1986);
(2) has received a Part B permit under 40 C.F.R. Part 264; or
(3) is disposing of hazardous wastes in a permitted underground injection well classified as Class I under 40 C.F.R. 144.6(a)(1).
