(a) The department will, in its discretion, waive a requirement of this chapter if an alternative method of protection is established and the health and safety of the public are reasonably assured.
(b) An application for a waiver must be made in writing and must include
(1) identification of the requirement for which the waiver is requested;
(2) reasons why the requirement cannot be met; and
(3) a description of the alternative method proposed for meeting the purpose of the requirement to be waived.
(c) A request for a waiver will be answered in writing within 30 days.
