(a) Private sector users using marine highway system terminal facilities are strictly liable for any damages to the facilities caused by their vessel operations. Private sector users will be billed for any repairs, at cost plus the state's overhead.
(b) The Alaska Marine Highway System is not liable for any damage to a private vessel which occurs while the vessel is using Alaska Marine Highway System terminal facilities.
