(a) The commissioner will waive a requirement of this chapter for a particular state highway system route or a portion of that route, if the commissioner issues a written determination that the
(1) state's best interests are served by the waiver;
(2) usefulness of the particular highway is not diminished;
(3) safety of other users is not compromised; and
(4) traveling public will not be unreasonably inconvenienced.
(b) The commissioner will not delegate the authority to make decisions under this section.
(c) Repealed 10/7/2001.
