13 AAC 25.050. Suspension, revocation, and refusal to renew license

(a) The commissioner or an employee of the department deputized by him for the purpose will, in his discretion, suspend, revoke or refuse to renew a license for any of the following causes:

(1) upon determination, subsequent to the original application, that the license could have been denied under 13 AAC 25.040 at the time of application;

(2) for an occurrence of a cause which would be grounds for denial of license under 13 AAC 25.040;

(3) for failure to maintain the standards required by 13 AAC 25.010 - 13 AAC 25.190;

(4) if the licensee has been found guilty of fraud or fraudulent practices or of inducing another to resort to fraud or fraudulent practices;

(5) if the licensee violates a provision of AS 28.17.

(b) No revocation, suspension or refusal to renew may be based on a determination under (a)(1) of this section unless action to revoke, suspend or refuse renewal is initiated by the commissioner or his representative within two years of original application, or for a cause as provided under (a)(2) - (a)(5) of this section unless action to revoke, suspend or refuse to renew is initiated by the commissioner or his representative within two years after the occurrence of the cause.
