Section 40. Denial of license

13 AAC 25.040. Denial of license

The commissioner will, in his discretion, deny a license to an applicant if, in his discretion, he determines that

(1) the applicant has made a material false statement or concealed a material fact in connection with his application;

(2) the applicant for a school license or an officer, director, stockholder or partner or other person directly or indirectly interested in the school was the former holder or was an officer, director, stockholder or partner in a corporation or a partnership which was the former holder of a school license which was revoked or suspended by the commissioner or when one of these persons was an applicant for a license which was denied for a cause which remains valid;

(3) the applicant for a school license or an officer, director, stockholder or partner in a corporation or partnership or a person directly interested in the business has been convicted of a felony crime involving violence, dishonesty, indecency or narcotics or of a misdemeanor crime of moral turpitude;

(4) the applicant has not met the requirements of 13 AAC 25.010 - 13 AAC 25.190 or the applicable sections of AS 28.17, with respect to the type of license applied for;

(5) the applicant for an instructor's license was the former holder of either a school or instructor's license which was suspended, revoked or denied by the commissioner for a cause which remains valid;

(6) the applicant for an instructor's license has been convicted of a felony crime involving violence, dishonesty, indecency or narcotics or a misdemeanor crime of moral turpitude;

(7) the applicant for a school license has failed to require all persons with a financial interest in the school to be signatories to the application;

(8) the applicant for an instructor's license has accumulated 12 points in the 12 months immediately before application or 18 points in the 24 months immediately before application, for conviction of offenses against traffic regulations, ordinances, or statutes; the points will be determined from the demerit point schedule set out in 13 AAC 08.210.
