(a) The purpose of this chapter is to
(1) standardize and simplify the management of records that contain behavioral health information; and
(2) improve the quality and timeliness of reporting behavioral health information.
(b) The provisions of this chapter cover electronic and other records, including paper and paper-based records, that contain behavioral health information submitted to the department
(1) for the department's use and retention on an electronic information system that is developed and maintained by the department for department use only; or
(2) through an electronic information system that is developed, maintained, and provided by the department for use by a provider identified in 7 AAC 85.010, and that is subject to the security requirements of 7 AAC 85.405 and 7 AAC 85.410.
