Section 530. Violation constituting an emergency

7 AAC 75.530. Violation constituting an emergency

(a) Subject to (c) of this section, if the department determines that a violation cited by the department in a notice of violation issued under AS 47.33.530 constitutes an emergency because of imminent danger to the health or safety of residents, the department will

(1) issue the notice of violation within 24 hours after determining that an emergency exists; the notice will state the nature of the emergency, the actions required to comply with AS 47.33 and this chapter, and a specific date and time for the home to correct the violation; and

(2) determine whether the violation has been corrected within the date and time specified in the notice.

(b) An assisted living home subject to a notice of violation constituting an emergency shall post the notice in a conspicuous location at the home until the department has determined that the violation has been corrected.

(c) If the department determines that the nature of the emergency described in (a) of this section warrants immediate closure of the assisted living home, the department will issue a notice of administrative sanction as required under AS 47.33.550 (c). The notice will

(1) state that the home must be closed immediately under authority of AS 47.33.550 (e), pending the outcome of any hearing requested under AS 47.33.550 (d); and

(2) be distributed as required by AS 47.33.550 (h).
