Section 40. Out of state agencies

7 AAC 56.040. Out of state agencies

(a) An out of state agency that is exempt from licensure as a child placement agency under AS 47.35.015 or 7 AAC 56.020 is not subject to the provisions of this section.

(b) An out of state agency that places two or fewer children a year into this state or from this state into another state or country may arrange for the placement or removal of a child in this state if the agency

(1) is licensed or otherwise appropriately approved for child placement functions in the state where the agency's principal office is located;

(2) has obtained approval from the coordinator of ICPC in this state; and

(3) has completed a plan of services that defines financial and service responsibilities of the out of state agency before, during, and after the placement of a child

(A) in this state with a licensed agency or a licensed social worker in this state; or

(B) out of state with an agency licensed or otherwise appropriately approved in the state where the child to be sent to this state resides or the child to be received from this state will reside.

(c) An agency licensed under this chapter may provide services for an out of state agency only if

(1) the agency licensed under this chapter verifies that the out of state agency is licensed, certified, or approved in the state where the agency's principal office is located;

(2) both agencies develop a written plan that defines financial and service responsibilities of both agencies before, during and after the placement of a child.

(d) An out of state agency placing three or more children per year in this state is subject to the provisions of 7 AAC 56.010 - 7 AAC 56.990 and shall designate a child placing worker located in this state to serve as an agent for the out-of-state agency.

(e) In this section, "out of state agency" means a child placement agency that does not maintain an office in this state.
