(a) In addition to those persons who are specifically listed under AS 47.35.015 as exempt from the requirements of this chapter, the department will consider the following persons as included in the exemptions from licensure under AS 47.35.015 :
(1) a person who arranges boarding care and no other type of child placement;
(2) a person who provides only foster home, adoptive home, or guardianship studies or licensing evaluations;
(3) an out of state Indian organization. as defined in 25 U.S.C. 1903(7); and
(4) an out of state agency that meets the provisions of 7 AAC 56.040 (a).
(b) In this section, "boarding care" means care provided in a foster home or a residential child care facility exclusively for children who are residing outside of their home community for 1 the purpose of obtaining education.
