(a) The commissioner will waive the requirements of 7 AAC 53.901 and 7 AAC 53.911 if the commissioner finds in writing that
(1) there is a single source of the expertise or knowledge required to provide a special residential child care service;
(2) one nonprofit corporation or municipality can clearly perform a required special service more satisfactorily than any other, because of the corporation's or municipality's prior work; or
(3) public necessity will not permit delay incident to the procedures otherwise required by those sections.
(b) The department will request a grant proposal, described in 7 AAC 53.905, from a nonprofit corporation or municipality selected to provide services under this section.
