Section 85. Resident's fund account

7 AAC 52.085. Resident's fund account

(a) Each juvenile correctional facility shall maintain an account for each resident's money in a local bank.

(b) If a juvenile correctional facility receives money intended for a resident, the facility shall provide a receipt for it and shall deposit it in the resident's account. If money is taken from a resident at admission, the facility shall provide a receipt for it and shall deposit it in the resident's account. A copy of each receipt must be given to the resident.

(c) A resident with money in the resident's account may send up to 50 percent of that money to the resident's parents or guardian when an unpaid restitution balance is owed to a victim, and the court has ordered the resident to pay restitution. If a restitution order has not been entered, or restitution has been paid in full, the resident may send any amount of that money to the resident's parents or guardian. However, a resident may not otherwise send money without the consent of the superintendent. A resident may not receive money from any person without the consent of the superintendent.

(d) The superintendent is authorized to sign checks against the residents' account. However, a person may not be given a loan from the account. The superintendent may establish procedures by which residents may draw from their money in the account from time to time.

(e) A facility shall pay each resident or the resident's parents or guardian all money due the resident upon release or transfer. Payment may be made by check.

(f) If a court has ordered a resident to pay restitution, at least 50 percent of the money in the resident's individual account shall be designated for payment of restitution. The treatment team established under 7 AAC 52.200 shall ensure that a plan for payment of restitution is included in the resident's treatment plan. The superintendent shall ensure that adequate records are maintained to account for restitution payments made from the resident's account.
