(a) Except as otherwise provided, this chapter applies only with respect to facilities operated and managed by employees of the Department of Health and Social Services. Facilities that accept the placement of juveniles, under contract with the division, shall comply with this chapter.
(b) Sections 7 AAC 52.005 - 7 AAC 52.040, 7 AAC 52.150 - 7 AAC 52.215, and 7 AAC 52.300 - 7 AAC 52.335 apply only to juvenile correctional facilities. Sections 7 AAC 52.395 - 7 AAC 52.455 apply only to juvenile detention facilities. Except as otherwise provided, 7 AAC 52.050 - 7 AAC 52.140, 7 AAC 52.250 - 7 AAC 52.270, and 7 AAC 52.350 - 7 AAC 52.380 apply to both juvenile correctional facilities and juvenile detention facilities.
(c) The director may, upon notification that a facility-wide emergency, endangering life, exists, suspend the operation of this chapter only so long as the emergency exists.
