(a) A recipient who is terminated from a consumer-directed or agency-based program may challenge that termination through the agency's grievance procedure, as the agency documented that procedure in the application materials required under 7 AAC 43.793.
(b) If the PCAT shows that an individual is not capable of managing consumer-directed services because of a lack of capacity as provided in 7 AAC 43.768, or if a person is terminated from a consumer-directed program because the individual lacks capacity to manage personal care services, the individual may appeal that decision under 7 AAC 49.
(c) If a service authorized by the PCAT service plan is reduced, terminated, or denied, the recipient may appeal that decision under 7 AAC 49.
