(a) When the utilization review committee or the medical practice review section recommends that a recipient does not, or in the future will not, require continued long-term care placement, the recipient (and, where appropriate, the family or guardian), the attending physician, the regional office, and the medical practice review section or the facility, depending on whether the division or the facility is proposing the discharge, shall be given 10 days' written notice before discharge. Recipients who receive notice of a proposed discharge have the hearing rights set out in 7 AAC 49.
(b) A facility's failure to comply with this section is a basis for withholding payment.
