Section 130. Eligible child

7 AAC 23.130. Eligible child

(a) Except as otherwise described in 7 AAC 23.110 - 7 AAC 23.220, a child is eligible for assistance under the handicapped children's program only if

(1) the child is a resident of Alaska;

(2) the child is under 21 years of age;

(3) the child suffers from a chronic disease, defect, or condition as described at 7 AAC 23.140;

(4) the disease, defect, or condition that causes the child to be handicapped can be ameliorated by treatment; and

(5) the child and the child's family meet the financial eligibility standards of 7 AAC 23.180.

(b) For a cost of surgical treatment, the department will waive, for no more than six months, the requirement that a child be under 21 years of age in order to be eligible if

(1) before the child was 21 years of age, the child was referred by the department for services that included a series of surgical treatments;

(2) the series of surgical treatments was commenced before the child was 21 years of age; and

(3) the surgical treatment is necessary to complete the series of surgical treatments.
