When a complaint is filed in superior court alleging a violation of AS 18.80, the plaintiff shall promptly serve a copy of the complaint on the executive director. If the same parties or issues are currently before the commission, the commission, in its discretion, will seek intervention in the civil action or deferral of the civil action to the commission, or it will close or hold in abeyance the complaint before the commission.
