The executive director may file a complaint alleging a violation of AS 18.80.220 (b) if an employer, labor organization or employment agency fails to make and retain the records specified in 6 AAC 30.810 - 6 AAC 30.830. If this failure is discovered during investigation of a complaint, the commission's staff may include in its determination a finding of noncompliance with AS 18.80.220 (b). Conciliation efforts will seek to secure compliance with 6 AAC 30.810 - 6 AAC 30.830, and failure of conciliation will result in a hearing on the recordkeeping issue.
