Section 660. Special advance ballot

6 AAC 25.660. Special advance ballot

(a) Under AS 15.20.082 , the director will send a special advance ballot for a state primary election, state general election, or state special election to a voter who has notified the director in writing that the voter expects to be living, working, or traveling outside the United States or in a remote area of the state where distance, terrain, or other natural conditions deny the voter reasonable access to a polling place at the time of the election. The voter may give written notice by

(1) including a statement, on the application for a by-mail ballot, that the voter expects to be outside the United States or in a remote area of the state at the time of the election;

(2) checking or otherwise marking the box provided for that purpose on the state application for a by-mail ballot;

(3) affixing the sticker provided for that purpose by the United States Department of Defense to the application for a by-mail ballot; or

(4) providing an overseas address in the space designated on an absentee by-mail application for ballot mailing address.

(b) A special advance ballot will be mailed to a voter who provides written notice under (a) of this section if the application is received not later than 32 days before the election in which the voter seeks to vote.

(c) A voter voting a special advance ballot shall mail the ballot to the director who shall maintain a record of each ballot received as prescribed under AS 15.20.081 (g).

(d) A voter receiving the special advance ballot will also be sent the official ballot as soon as it is available. On or after the 15th day following the election, the director, in the presence and with the assistance of the state review board, will determine if the regular ballot sent to the voter under AS 15.20.082 (d) has been received. If the voter's regular ballot has been received not later than the deadlines established in AS 15.20.081 (e) and (h), the voter's special absentee ballot will not be reviewed or counted, and the special advance ballot will remain sealed in the oath and affidavit envelope. If the director determines that the regular ballot has not been received in the time required by law, the state review board shall review and count the special advance ballot under AS 15.20.220 . The special advance ballot will be reviewed in the same manner prescribed for the district absentee ballot counting review under AS 15.20.203 , and will be counted under AS 15.15.360 .
