(a) To participate in the program, a provider must be eligible under 4 AAC 64.020 and must, on a form provided by the department, certify that the provider will
(1) participate in the day care assistance program under AS 14.38.100 and 4 AAC 65;
(2) make available 15 percent of the provider's facility spaces, or one space, whichever is greater, to families who are participating in the day care assistance program under AS 14.38.100 and 4 AAC 65 and who have an attendance authorization issued under 4 AAC 65.101;
(3) use the grant money solely for the operation of the provider's facility; and
(4) if space and staff are available, accept into care a child of a family who is participating in the day care assistance program under AS 14.38.100 and 4 AAC 65 and who has an enrollment authorization issued under 4 AAC 65.101.
(b) The number of facility spaces to be made available under (a)(2) of this section is based on the provider's average daily full-time equivalent units of care for the calendar month preceding the month in which a family requests care. For a provider that does not have an established attendance rate, a fair and reasonable attendance rate must be charged in satisfying the program participation requirement in (a)(2) of this section. An attendance rate is considered to be fair and reasonable if it either is consistent with attendance rates charged by other providers in the area or is a proration of the provider's enrollment rate.
