3 AAC 154.100. Site control

A municipality shall demonstrate to the department that it has site control for capital projects, facilities, and other forms of property that are built, acquired, or used in capital projects for which an appropriation was made under AS 37.06.010 (e). If the project involves the occupancy or use of real property, the municipality receiving the appropriation for the capital project shall demonstrate to the department that the municipality has the legal right to access, occupy, and use the real property.
