Section 900. Definitions

3 AAC 143.900. Definitions

In this chapter, unless the context clearly indicates otherwise,

(1) "Native village council" means a council organized under sec. 16 of the Indian Reorganization Act, 25 U.S.C. 476, or a traditional village council, recognized by the United States as eligible for federal aid to Indians, that has irrevocably waived, in a form approved by the Department of Law, any claims to sovereign immunity that might arise in connection with the use of grant money under this chapter;

(2) "commissioner" means the commissioner of the Department of Commerce, Community, and Economic Development;

(3) "department" means the Department of Commerce, Community, and Economic Development;

(4) "valid claim for reimbursement" means a legally recognizable right of recovery against persons responsible for the Exxon Valdez oil spill for activities set out in 3 AAC 143.020(b) .
