(a) Only municipalities or Native village councils within coastal communities directly affected by the Exxon Valdez oil spill may receive a grant under this chapter for a project. Two or more municipalities or Native village councils may jointly submit a single grant application.
(b) If an applicant is located within an eligible organized borough that exercises sufficient areawide powers to implement the proposed project, the borough will be considered the only eligible applicant. The borough may submit a grant application for any community within its boundaries.
(c) If an applicant is located in the unorganized borough, or if the borough in which the community is located does not exercise sufficient powers to implement the proposed project, any directly affected municipality or Native village council in that borough that exercises sufficient powers may apply. The department will give preference to a municipality over other applicants from the same community.
