3 AAC 130.122. Underpayment and adjustment

(a) For good cause, and upon a showing of a good faith effort by the applicant to comply with the provisions of this chapter, the commissioner will, in the commissioner's discretion, determine that an applicant received less than it was entitled to receive in an entitlement year. Upon such a determination, the department will request supplemental money from the legislature to fund the underpayment adjustment. The adjustment will be the difference between the amount received and the amount the applicant was entitled to receive.

(b) A request for adjustment under this section must be in writing and must be postmarked on or before December 1 of the computation year following the entitlement year in which the underpayment was made. The request must include relevant evidence in support of the applicant's claim.
