(a) An insurer intending to use a schedule rating plan that was approved before July 24, 1998 shall, no later than November 30, 1998, submit a letter to the director stating its position whether the schedule rating plan it intends to use complies with the requirements of 3 AAC 29.400 - 3 AAC 29.469. A copy of the schedule rating plan the insurer intends to use must be attached to the letter.
(b) If the director determines that the schedule rating plan that was approved before 7/24/98 does not meet the requirements of 3 AAC 29.400 - 3 AAC 29.469, the director will, in the director's discretion, disapprove the insurer's use of the previously approved schedule rating plan under the director's authority set out in AS 21.39.050 .
