An insurer is not required to provide coverage for the payment of attorney fees awarded as costs under Alaska Rule of Civil Procedure 82 against an insured in a policy under which an insurer has no right or duty to provide a defense or in a policy under which an insurer has not agreed to indemnify the insured for the costs of defense. Nothing in this section affects an insurer's right to participate in the defense of its insured at its own cost if that right is part of the policy.
