If a lobbyist spends an amount to provide food or beverages for immediate consumption to a legislator, a legislative employee, or a public member of the Select Committee on Legislative Ethics established in AS 24.60.130 , the lobbyist shall report the amount as a
(1) disbursement or expenditure for food and beverages under AS 24.45.051 , for food and beverages that are provided in a place of public accommodation; or
(2) gift under AS 24.45.051 , for food or beverages that are provided in a place other than a place of public accommodation.
