AS 39.35.010. Purpose and Effective Date; Federal Qualification Requirements.
- (a) The purpose of this chapter is to encourage qualified personnel to enter and remain in the service of the state or a
political subdivision or public organization of the state by establishing a system for the payment of retirement,
disability, and death benefits to or on behalf of the employees.
- (b) The Public Employees' Retirement System of Alaska is hereby created. The system created becomes effective as of
January 1, 1961, at which time contributions by the state and its employees begin.
- (c) The retirement system established by this chapter is intended to qualify under 26 U.S.C. 401(a) and 414(d) (Internal
Revenue Code) as a qualified retirement plan established and maintained by the state for its employees and for the
employees of political subdivisions, public corporations, and public organizations of the state, and for the employees
of other employers whose participation is authorized by this chapter and who participate in this system.
- (d) An amendment to this chapter does not provide a person with a vested right to a benefit if the Internal Revenue
Service determines that the amendment will result in disqualification of the plan under the Internal Revenue Code.
