AS 34.60.070. Expenses Incidental to Transfer of Property.
The state agency, as soon as practicable after the date of payment of the purchase price or the date of deposit in
court of funds to satisfy the award of compensation in a condemnation proceeding to acquire real property, whichever is
the earlier, shall reimburse the owner, to the extent the department considers fair and reasonable, for expenses
necessarily incurred for
- (1) recording fees, transfer taxes, and similar expenses incidental to conveying the real property to the state agency;
- (2) penalty costs for prepayment of a preexisting recorded mortgage entered into in good faith encumbering the real
property, if the mortgage was a valid lien on the property for not less than 180 days before the initiation of
negotiations for the acquisition of the property; and
- (3) the pro rata portion of real property taxes paid that are allocable to a period subsequent to the date of vesting
title in the state, or the effective date of possession of the real property by the state agency, whichever is the
earlier.
